PUBLIC OFFER AGREEMENT

This document is a public offer to conclude a sales agreement between the Buyer and the Sellers — Sole Proprietor Anton Volodymyrovych Prykhodko and Sole Proprietor Olena Anatoliivna Prykhodko, who are partners in the operation of the online store I’MCUM, located at https://imcum.com.ua.

1. General Provisions

1.1. This agreement is a public offer in accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine. Its terms are the same for all Buyers, regardless of status.

1.2. Acceptance of this offer is made by placing an order on the website. From that moment, the Buyer confirms agreement with all terms of the agreement.

3. Subject of the Agreement

The Sellers agree to transfer ownership of the products listed on the website to the Buyer, and the Buyer agrees to accept and pay for the products under the terms of this agreement.

4. Order Placement

4.1. Orders are placed by the Buyer independently on the website or with the help of a consultant.

4.2. All prices listed on the website are current at the time of ordering and include VAT (if applicable).

5. Payment

5.1. The Buyer may pay for the goods via:

• bank card through online payment system;
• cash on delivery (COD);
• direct transfer to the Seller’s account.

6. Delivery

6.1. Delivery is carried out across Ukraine by courier services. Packaging is discreet and does not reveal the contents.

6.2. Delivery time is 1–3 business days after order confirmation.

7. Warranty and Returns

7.1. A 12-month warranty is provided for all products.

7.2. In case of defects, goods may be exchanged or returned in accordance with the Law of Ukraine "On Consumer Rights Protection."

7.3. Intimate products that have been used cannot be returned or exchanged (Article 13 of the Law "On Consumer Rights Protection").

8. Rights and Obligations of the Parties

The Sellers agree to:

• process orders in a timely manner;
• ship quality goods in appropriate packaging;
• ensure confidentiality of the Buyer’s personal data.

The Buyer agrees to:

• provide accurate contact information;
• pay for the order using the selected payment method;
• receive the order at the designated delivery address.

9. Privacy

9.1. The Sellers guarantee the confidentiality of the Buyer’s personal information. Data is used solely for processing orders and is not shared with third parties.

10. Dispute Resolution

10.1. All disputes and disagreements shall be resolved through negotiation. If no agreement is reached, the dispute shall be resolved in accordance with applicable Ukrainian law in court.

11. Final Provisions

11.1. The Sellers reserve the right to amend the terms of this offer. Changes take effect upon publication on the website.

This agreement is valid from the moment of acceptance and until full fulfillment of obligations by both parties.
